Privacy Policy

These terms include the QC Sample Date Privacy Policy, located at Privacy Policy and incorporated herein by this reference.

Additional Terms and Conditions

You agree additional terms and conditions may apply to specific products, orders, or your use of certain portions of the Services ("Additional Terms"). Such Additional Terms are made part of these Terms by reference. If there is a conflict between these Terms and the Additional Terms, the Additional Terms shall control.

Responsibility of Members

Please be advised that we reserve the right to refuse admission to the Panel or to terminate your Panel membership, immediately and without notice, for your violation of these Terms or for any other reason in our sole absolute discretion. By signing up for the Panel, you acknowledge and agree, without limitation, to the following:

1. You must understand English. You must be at least eighteen (18) years old to join the Panel, and at least 13 years old with parental consent to participate in any Research. Requests may be made to verify your age.
2. You may be required to provide verification of identity and address prior to ANY payment or order upon our request or if any fraudulent activity is suspected.
3. Only one account may be held per individual. You may only sign up for offers in your own name, and only one person may use the account. Multiple accounts per household are allowed, but other individuals need to create their own account, and ID verification may be requested to verify your identity. Certain areas of the website may only be accessible by one member in the household.
4. You must NOT sign up or log in from a proxy IP. Login from cell phones and public internet connections (such as a school, Wi-Fi hot-spot or a library) is allowed, but certain areas may be limited. You may not play games in a browser while connected to the Site via a cell phone. Requesting prizes or withdrawals from public locations is not permitted.
5. If you use a credit card for offers, the credit card must be in your name and no one else's!
6. You are solely responsible for any and all use of your QC Sample Date account and you may not authorize another to use or otherwise access your account. All information provided by yourself during registration and offer completion must be your own and may not pertain to any other individual. False information including, but not limited to, addresses, phone numbers and names will constitute an attempt to commit fraud and we reserve the right to suspend your account pending further investigation.
7. You are not allowed to use an internet voicemail/internet phone number on your QC Sample Date account.
8. You cannot repeat offers on QC Sample Date that you have completed on other sites. Likewise, offers may only be completed once on QC Sample Date unless indicated otherwise. Categories that allow multiple completions include, but are not limited to, daily surveys, daily clicks and recurring tasks.
9. You are not permitted to cancel offers right after credit is received, nor are you permitted to encourage others to do so. You must fulfil all offer requirements to qualify for credit. Early cancellation or incorrect completion is considered fraud and may result in credit reversal or suspension of your account.
10. You are not permitted to share or use any confidential information you obtain through surveys. Legal action may take place if unauthorized use of any content is discovered.
11. Fraudulent members are NOT welcome on QC Sample Date. We rely on the honesty of all parties in order to remain an asset to all members. In order to ensure this honesty, to the best of our ability, we closely monitor our site for fraud and abuse.
12. Should any instances of fraud, system abuse, or any type of activity deemed inappropriate or illegal by QC Sample Date be detected, it will result in account termination and possible legal action. Any and all earnings (whether reversed by the advertisers or not) will be revoked without warning and any pending orders cancelled.
13. Anyone caught cheating and/or committing fraud in any capacity will be held in violation of these Terms and will thus no longer be protected by them.

Restricted Behaviors

Without limiting the above, you further agree you will not use the Services for any of the following purposes:

1. Posting, communicating, or transmitting any material which infringes on any intellectual property, publicity, or privacy right of another person or entity;
2. Engaging in conduct which may constitute a criminal offense, give rise to civil liability, or otherwise violate any law or regulation;
3. Attempting to interfere in any way with the QC Sample Date network security, or attempting to use the Services to gain unauthorized access to any other computer system;
4. Using spiders, robots, or other automated data mining techniques to catalogue, download, store, or otherwise reproduce or distribute data or content available in connection with the Services;
5. Manipulating the results of any survey;
6. Collecting any personal information of any other user of the Services;
7. Posting or transmitting any threatening, libelous, defamatory, obscene, pornographic, lewd, scandalous or inflammatory material or content or any material or content which could otherwise violate applicable laws; or
8. Engaging in any fraudulent activity, including but not limited to speeding through surveys, taking the same survey more than once, masking or forging your identity, submitting false information during the registration process, submitting false or untrue survey data, or redeeming or attempting to redeem rewards, prizes or incentives through false or fraudulent means.

Relationship of the Parties

You and QC Sample Date are independent contractors, and nothing in these Terms creates any partnership, joint venture, agency, franchise, sales representative or employment relationship between you and QC Sample Date. You understand that you do not have authority to make or accept any offers or make any representations on behalf of QC Sample Date. You may not make any statement, whether on a site maintained by you or otherwise, that would contradict anything in this section. You are solely responsible for the reporting and payment of any taxes for money earned while using the QC Sample Date program.

Ownership

You acknowledge and agree the content, materials, text, images, videos, graphics, trademarks, logos, button icons, music, software, and other elements available on the Services are the property of QC Sample Date, our licensors, or our clients and are protected by copyright, trademark, and/or other proprietary rights and laws. You agree not to sell, license, rent, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, modify, or create derivative works from any content or materials on the Services.

Information and content made available to you through the Services may contain trade secrets or other confidential or proprietary information of QC Sample Date or our clients, suppliers, or licensors. You must hold in strict confidence, and not disclose to any other person, any information or content you access or learn in connection with your participation in any survey, project, questionnaire, or other activity related to the Services. You are prohibited from sharing with any third party photographic or other imagery, information, or any other content from your activities with respect to the Services. You must not use any such information or content for any purpose other than your participation in the Services in accordance with these Terms.

You hereby agree to notify us immediately if you learn of or suspect any use or disclosure of, or access to, any such information or content other than as specifically authorized in these Terms.

No part of the Site, e-mails, newsletters, updates, templates or promotions may be reproduced in any way without our prior consent. This includes, but is not limited to, use of QC Sample Date images, ideas, text, terms or any other information we consider as copyrighted material. Publishing/posting/quoting part or all of such content online or off-line by any means or method is strictly prohibited.

Rewards

You may have the opportunity to earn rewards in connection with your participation in Research. We reserve the right to refuse to grant rewards for any reason in our sole discretion, including, but not limited to, fraud, system abuse and early termination. You are doing all surveys on a voluntary basis with the understanding that no rewards are guaranteed for the time you spend completing offers. Points or other rewards will only be awarded after verification that offers completed have been validated and that the offer(s) has been paid upon by the advertiser. QC Sample Date will never be deemed as owing payment to any member. There are occasional delays in receiving commissions from the advertisers and, by participating in the QC Sample Date program, members understand and acknowledge that no payment shall be made until QC Sample Date has received such payment from its advertisers.

QC Sample Date is not responsible for rewards redeemed via Amazon or other merchants through our rewards gallery. Members are responsible for reviewing the product and seller information page on Amazon before ordering via our rewards gallery. We provide Amazon product links on all product pages in the rewards gallery. The estimated delivery date displayed on the orders page is an approximate calculation of the time it will take for your order to be delivered based on the information we have in our system. It is not a guaranteed delivery date and members should refer to the product page on Amazon for specific dates. In the event that an item is damaged or delayed we will contact Amazon on your behalf. We cannot issue refunds or an exchange until this is finalized with Amazon.

Spam

QC Sample Date may occasionally send you periodical e-mails containing information regarding site updates and maintenance. We only send these newsletters if you are subscribed to them, and you can opt-out from your account management page or by clicking the unsubscribe link in any of the e-mails sent. You may not promote your referral links through unsolicited emailing, newsgroup postings, or any other method of mass communication. Failure to comply will result in immediate termination of your membership with QC Sample Date and may result in legal prosecution.

Fraud

Using fraudulent information to complete offers and/or completing offers with fraudulent intent will result in the member's account being deleted without notice and relinquishment of all monies in the account. Fraud includes, but is not limited to, the following: using stolen credit cards to complete offers; using false information to complete offers; using information that is not one's own to complete offers; using prepaid gift and/or credit cards to complete offers; completing the same offer multiple times; cancelling offers and/or trials prior to receipt of product and/or service.

Multiple signups by any individual member shall be grounds for immediate termination of all involved accounts. QC Sample Date reserves the right to file charges against an individual in attempt to recover any earnings received. We have a tough anti-cheat system in place making it extremely difficult to cheat; however, if someone is caught cheating or making attempts to do so, we reserve the right to suspend the member's account, resulting in forfeiture of all earnings.

Inactive Member Accounts

Membership at QC Sample Date is free: there is no charge to be a member or to earn points. Please be advised that if your account becomes inactive, we reserve the right to terminate your account, at which point any points or other rewards you've earned may be forfeited. Determining whether an account has become inactive and whether a member forfeits any points in connection with an inactive account will be determined in our sole discretion.

Disclaimer

YOU ASSUME ALL RESPONSIBILITY AND RISK WITH RESPECT TO YOUR USE OF THE SERVICES. THE SERVICES, AND ALL CONTENT, MERCHANDISE, AND OTHER INFORMATION ON OR ACCESSIBLE FROM OR THROUGH THE SERVICES OR A LINKED SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NONINFRINGEMENT, SECURITY, OR ACCURACY. SPECIFICALLY, BUT WITHOUT LIMITATION, QC Sample Date DOES NOT WARRANT THAT: (1) THE INFORMATION WITH RESPECT TO THE SERVICES IS CORRECT, ACCURATE, OR RELIABLE; (2) THE FUNCTIONS CONTAINED WITH RESPECT TO THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE; (3) DEFECTS WILL BE CORRECTED; OR (4) THE SERVICES OR THE SERVERS THAT MAKE THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Indemnification

You agree to indemnify, hold harmless, and defend QC Sample Date, including its parents, subsidiaries, divisions, and affiliates, together with their respective officers, directors, employees, agents, and affiliates, from any and all claims, liabilities, damages, costs, and expenses of defense, including but not limited to attorneys' fees, in any way arising from or related to your use of the Services, your violation of these Terms, content posted to the Services by you, or your violation of any law or the rights of a third party.

Limitation of Liability

IN NO EVENT SHALL QC Sample Date, ITS AFFILIATES, OR ANY OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUCCESSORS, SUBSIDIARIES, SUPPLIERS, AFFILIATES, OR THIRD PARTIES PROVIDING INFORMATION ON THE SERVICES BE LIABLE TO ANY USER OF THE SERVICES OR ANY OTHER PERSON OR ENTITY FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, CONSEQUENTIAL, OR EXEMPLARY DAMAGES (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, OR LOSS OF USE) ARISING OUT OF THE USE OR INABILITY TO USE THE SERVICES, WHETHER BASED UPON WARRANTY, CONTRACT, TORT, OR OTHERWISE, EVEN IF QC Sample Date OR ANY OF THE RELATED PARTIES NAMED ABOVE HAS BEEN ADVISED OF OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES OR LOSSES.

IN NO EVENT SHALL THE TOTAL LIABILITY OF QC Sample Date, ITS AFFILIATES, OR ANY OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUCCESSORS, SUBSIDIARIES, SUPPLIERS, AFFILIATES, OR THIRD PARTIES PROVIDING INFORMATION ON THE SERVICES TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION RESULTING FROM YOUR USE OF THE SERVICES, WHETHER IN CONTRACT, TORT (INCLUDING, BUT NOT LIMITED TO, ACTIONS BASED ON NEGLIGENCE) OR OTHERWISE, EXCEED THE GREATER OF: (1) THE TOTAL DOLLAR VALUE OF ALL REWARDS YOU HAVE ACCUMULATED IN THE TWELVE (12) MONTHS PRECEDING THE DISPUTE OR (2) ONE HUNDRED AND FIFTY DOLLARS ($150).

ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATED TO USE OF THE SERVICES OR THESE TERMS MUST BE FILED WITHIN ONE (1) YEAR AFTER SUCH CLAIM OR CAUSE OF ACTION AROSE.

The provisions of this section survive termination or expiration of THESE TERMS.

Non-Liability

At no time will QC Sample Date be liable for anything resulting from your own independent use of your account. You acknowledge and agree that you are participating in the Panel and any Research voluntarily, and are solely and completely responsible for your own actions. You acknowledge and agree that QC Sample Date will also bear no responsibility for its own legal actions in connection with your account, including without limitation suspension or termination of your account or dissemination of information concerning your account. You acknowledge and agree that QC Sample Date is neither ensuring nor endorsing products or services advertised on QC Sample Date or discussed in Research. Members are solely responsible for any and all consequences of decisions made with regard to any partners' websites.

Dispute Resolution

All disputes arising under these Terms shall be governed by and interpreted in accordance with the laws of Florida, without regard to principles of conflict of laws. The parties to these Terms will submit all disputes arising under this agreement to arbitration in Orlando, Florida, before a single arbitrator of the American Arbitration Association ("AAA"). The arbitrator shall be selected by application of the rules of the AAA, or by mutual agreement of the parties, except such arbitrator shall be an attorney admitted to practice law in Florida. No party to these Terms will challenge the jurisdiction or venue provisions as provided in this section. Nothing contained herein shall prevent the party from obtaining an injunction.

Class Action Waiver

Any arbitration or court trial, whether before a judge or jury or pursuant to judicial reference, related to any claim under these Terms will take place on an individual basis, without resort to any form of class or representative action ("Class Action Waiver"). THIS CLASS ACTION WAIVER PRECLUDES ANY PARTY FROM PARTICIPATING IN OR BEING REPRESENTED IN ANY CLASS OR REPRESENTATIVE ACTION REGARDING A CLAIM UNDER THIS POLICY. Regardless of anything else herein, the validity and effect of the Class Action Waiver may be determined only by a court and not by an arbitrator.

Termination

Termination of a member's account constitutes forfeiture of the privilege to create a new account. Only one account per individual is allowed; if more than one account is created for the same individual, this is considered fraud and both accounts will be deleted with all monies forfeited.

Members are required to use true and accurate account information when signing up and to keep their account information up-to-date at all times. If a member is found to have incomplete, inaccurate, or false account information, his/her account is subject to termination without notice. Members may cancel their use of QC Sample Date at any time by sending a support ticket requesting as such. These terminated accounts shall lose any and all potential benefits associated with the site, including, but not limited to, points earned and prizes requested. QC Sample Date will not offer or owe anything to members whose accounts have been terminated and/or suspended. QC Sample Date reserves the right to terminate the account and withhold orders from any and all members who are deemed to have fraudulently completed offers, no matter how insignificant the degree of fraud.
